By checking the "I agree to the Terms, Privacy Policy, and Refund Policy" box at booking or account creation, you agree to these Terms. If you do not agree, do not use the service.

1. About these Terms

These Terms form a binding agreement between you and Stinky Bins. They cover one-time cleans and subscription plans. Our Privacy Policy and our Refund and Cancellation Policy are part of these Terms by reference.

2. Definitions

  • "Service" means cleaning, sanitizing, and deodorizing residential curbside bins.
  • "Bin" means a residential garbage, recycling, or organics cart.
  • "Month-to-Month Subscription" or "Subscription" means a recurring plan billed per visit on a monthly, quarterly, or bi-annual cadence, which auto-renews until you cancel.
  • "Prepaid Annual Package" means a fixed set of cleans paid upfront at a discounted package price, as described in section 8A.
  • "Flex Credit Pack" means a prepaid bundle of cleans redeemed on demand, as described in section 8B.
  • "Service address" means the Kelowna property where we perform the Service.
  • "In progress" means a clean for which we have started work at your service address.
  • "Completed" means a clean we have finished performing at your service address. A visit where the Service did not happen is not a completed clean.
  • "Reschedule fee" means the capped trip or reschedule fee of $10 described in section 9, charged when we attend and cannot perform the Service because of an access issue.
  • "Dirty-bin surcharge" means the $15 per Bin fee described in section 6, which applies when a Bin is full or partially full during your scheduled clean, meaning it holds any garbage we would have to remove first, so we must empty or transfer it before cleaning, and which you acknowledge and authorize at booking.

3. The Service

We power wash the exterior and interior of your Bins using cold water and eco-friendly, biodegradable, pet- and family-safe cleaning agents, then sanitize and deodorize them. We connect our hose to your outdoor tap and run a gas-powered washer, so we do not need your electrical outlet. We provide the hose and the cleaning supplies.

The Service is cosmetic and hygienic cleaning. It is not a repair, restoration, or refinishing service. We perform the Service with reasonable skill and care.

4. What we need from you

To receive the Service, you must provide:

  • An accessible outdoor tap (spigot) we can connect a hose to. We cannot serve a property without one.
  • Safe, unobstructed access to the Bins on the scheduled day.
  • Bins that are empty for your scheduled clean. If a Bin is full or partially full, meaning it still holds any garbage we would have to remove first, the dirty-bin surcharge in section 6 applies, or we reschedule.
  • Secured pets and disclosure of any hazards on the property.

You have a duty to tell us before service if a Bin is cracked, brittle, fragile, or damaged. See sections 4 and 11.

If we cannot access the Bins or the tap, or the Bins are not ready, section 9 and the Refund and Cancellation Policy apply.

5. Scheduling and the day-after model

We schedule cleans for the day after your municipal garbage collection day, when Bins are empty and at the curb. Collection days are set by the Regional District of Central Okanagan and may shift on statutory holidays. We may adjust your clean date to match collection changes, weather, or routing, and we will notify you.

You may reschedule or skip a clean within the notice window stated in the Refund and Cancellation Policy.

6. Pricing, taxes, and the dirty-bin surcharge

  • Prices are shown at booking and on your account. All prices are in Canadian dollars and exclude GST. We add 5 percent GST and show it on your invoice.
  • Dirty-bin surcharge: your Bins must be empty for the scheduled clean. You acknowledge at booking that if a Bin is full or partially full during your scheduled clean, meaning it still holds any garbage we would have to remove first before we can clean it, a $15 per Bin fee applies because we must empty or transfer it before cleaning. We charge it only when we attach a before-photo of the Bin to your invoice. Instead of charging the fee, we may reschedule the clean. The fee is conditional and is not charged at booking. You authorize this fee by checking the acknowledgment box at booking.
  • We may change prices on a going-forward basis. For material price changes, section 8 and section 21 apply. Price changes do not affect a clean already booked and paid.

7. Payment

  • Subscriptions require a valid credit card kept on file. We bill the card automatically for each visit through our payment processor (Stripe). Card data is handled by Stripe and does not pass through our servers.
  • One-time cleans are paid by credit card through Stripe.
  • Prepaid annual packages are paid in full upfront by credit card at the discounted package price.
  • Flex Credit packs are prepaid by credit card. You may pay for the whole pack upfront or in quarterly installments with no interest or fees; the total equals the upfront price. You redeem one credit each time you book a clean.
  • You authorize us to charge your payment method for the Service, the dirty-bin surcharge you acknowledged at booking, any reschedule fee, and GST.
  • If a payment fails, we may pause or cancel the Service until payment is resolved.

8. Subscriptions, renewal, and your ongoing approval

We offer two ways to subscribe: month-to-month, which auto-renews until you cancel, and prepaid annual packages, which you pay upfront and which do not auto-renew (see section 8A). This section covers month-to-month Subscriptions. British Columbia's auto-renewal rules apply to month-to-month Subscriptions, and we follow them.

  • We do not treat your silence as consent to renew. Before each billing cycle, we send you an advance reminder that states the renewal date and the amount we will charge, and includes a one-click link to skip or cancel that cycle.
  • We obtain your ongoing approval to continue the Subscription as required by British Columbia law.
  • Cancellation is easy and immediate for cleans not yet in progress. You may pause or cancel a Subscription at any time from your account or by contacting us, and the cancellation takes effect for cleans that are not yet in progress.
  • We do not lock you into a fixed term. The Subscription is ongoing until you cancel.
  • You may cancel at any time, before or after a renewal, with no fee or penalty.
  • We disclose the cadence and per-visit price at signup and on your account.
  • See the Refund and Cancellation Policy for cancellation timing and any clean that is already in progress.
  • We may suspend or end a Subscription for non-payment, loss of tap access, repeated access failures, or breach of these Terms.

8A. Prepaid annual packages

  • A prepaid annual package is a fixed set of cleans, for example 12 monthly cleans, that you pay for upfront at a discounted package price. We show the package price and the number of cleans at booking.
  • A package does not auto-renew. When it ends, we may invite you to buy again, and any new package is a new purchase you choose to make. We do not auto-charge you for a new package.
  • You may cancel a package at any time. If you cancel before we deliver all the cleans, we refund the unused cleans at the package per-clean rate, with no administrative fee. We do not keep payment for cleans we will not deliver, and we do not refund cleans we already delivered.

8B. Flex Credit packs

  • A Flex Credit pack is a prepaid bundle of cleans (minimum 4 credits) that you redeem whenever you want, with no set schedule. Credits are denominated in cleans: one credit equals one clean at your current bin count.
  • You may pay for the pack upfront or in quarterly installments with no interest or fees; the total equals the upfront price. We add the credits to your account when you pay.
  • Credits do not expire.
  • A pack does not auto-renew. You buy more credits when you choose to.
  • You may request a refund of unused credits at any time. We refund unused credits at the price you paid per credit, with no administrative fee. We do not refund credits you have already redeemed.

8C. Your written contract and pre-purchase disclosure

Prepaid Annual Packages and Flex Credit Packs are future performance contracts: you pay now for cleans delivered later. For each purchase of this type, we provide a written contract or receipt that includes:

  • our legal name, address, and phone number,
  • a description of the Service,
  • the itemized price and the number of cleans purchased,
  • when and how we will deliver the cleans,
  • payment terms, and
  • your cancellation and refund rights as set out in sections 8A, 8B, and the Refund and Cancellation Policy.

We deliver this document to you within 15 days of purchase. Before you pay, we display the cancellation, refund, and renewal terms on the payment screen itself, not only by a link.

9. Access failures and bins not ready

If, on the scheduled day, we attend and a Bin is full or partially full, meaning it still holds any garbage we would have to remove first, the dirty-bin surcharge in section 6 applies and we clean the Bin after emptying it, or we reschedule. If instead we cannot access the property, the Bins, or the tap at all, we do not perform the Service and we do not bill you for a clean that did not happen. In that case, we may:

  • clean what we safely can, or
  • charge a capped reschedule fee of $10 and reschedule.

We charge the reschedule fee only when we attach a photo of the access issue to your account and we have logged an attempt to contact you. We will always try to contact you first. Where a Bin is full or partially full, meaning it still holds any garbage we would have to remove first, the dirty-bin surcharge in section 6 applies and we attach a before-photo. We do not bill the full price of a clean we did not perform.

10. Results disclaimer

Bins vary in age and condition. We clean to a high standard with reasonable skill and care, but results depend on the Bin. Old, faded, scratched, cracked, or sun-damaged Bins may not look new, and stains, odours, or discoloration that have set into the plastic may be permanent. This narrow cosmetic disclaimer covers only the appearance of set-in stains and of old, faded, or damaged plastic. It does not limit our duty to perform the Service with reasonable skill and care. If a clean does not meet our standard, the satisfaction guarantee in the Refund and Cancellation Policy is your agreed remedy, and this disclaimer does not displace it.

11. Assumption of risk and release for pre-existing damage and normal wear

You acknowledge this section at checkout.

Nothing in this section releases us from liability for personal injury or death caused by our negligence, for our gross negligence, or for any non-waivable right you have under the British Columbia Business Practices and Consumer Protection Act.

Standard pressure washing carries normal, expected effects on worn or damaged Bins. To the extent the law allows, and subject to the carve-out above, you accept the risk of, and release us from liability for:

  • pre-existing damage, including cracks, broken or loose lids, hinges, wheels, axles, and faded or brittle plastic, and
  • genuinely normal wear that results from standard cleaning.

You have a duty to tell us before service if a Bin is cracked, brittle, damaged, or fragile.

12. Limitation of liability

Subject to the carve-out below and to the extent permitted by law:

  • Our total liability for any claim related to the Service is limited to the greater of the fees you paid to us in the prior 12 months or $500.
  • This cap does not apply to property damage caused by our own negligence, which is not limited by this section.
  • We are not liable for indirect, incidental, special, or consequential damages, or for lost profits or loss of use.

Nothing in these Terms limits or excludes liability that cannot be limited or excluded by law, including liability for death or personal injury caused by our negligence, for our gross negligence, for fraud, or for any non-waivable right you have under the British Columbia Business Practices and Consumer Protection Act. These carve-outs override the cap and every other limit in these Terms.

13. Indemnity

To the extent the law allows, you agree to indemnify us against third-party claims that arise from your breach of these Terms, your failure to disclose a hazard, or your unlawful conduct. This indemnity does not apply to anything caused by our own negligence.

14. Warranties and consumer protection

We perform the Service with reasonable skill and care. We do not disclaim warranties of any kind. Instead, we expressly preserve all conditions and warranties that cannot be excluded under the British Columbia Business Practices and Consumer Protection Act and the Sale of Goods Act, and nothing in these Terms excludes or limits any right you have under those laws that cannot be excluded or limited. The only cosmetic outcome we do not warrant is the appearance of set-in stains and of old, faded, or damaged plastic, as described in section 10.

15. Photos and marketing

We may take before and after photos of your Bins for quality control and marketing. We will not include your name, full address, or other identifying details without your consent. You may opt out by telling us at hello@stinkybins.ca. For the photos attached to invoices and to access-failure records, see sections 6 and 9.

16. Texts, marketing, and anti-spam (CASL)

When you give us your mobile number and opt in, you agree to texts from Stinky Bins as described here and in our Privacy Policy. We send three kinds:

  • Verification codes you ask for. You opt in by entering your number and requesting a code.
  • Service texts about your bookings: confirmations, clean-day reminders, completion notices, and payment issues. These come with the Service, not as marketing.
  • Promotional texts and emails. We send these only with your express opt-in through a separate, unchecked box, and we never make that consent a condition of buying the Service.

Message frequency varies with your activity, and message and data rates may apply depending on your carrier and plan. Reply STOP to any non-verification text to opt out, or HELP for help. Every marketing message names us and carries a working unsubscribe link.

We honour opt-outs within 10 business days and keep each unsubscribe method working for at least 60 days after we send a message. We do not sell or share your mobile number or your opt-in with third parties for their marketing, and we keep a record of the consent you give. Your mobile carrier is not liable for delayed or undelivered texts.

17. Weather and safety

We may reschedule for freezing temperatures, severe weather, or any condition we judge unsafe. We do not pressure wash in freezing conditions. Rescheduling for weather is not a cancellation by you and incurs no fee. This clause is separate from the Force Majeure clause in section 27.

18. Environmental statement

Our cleaning agents are biodegradable and pet- and family-safe. We do not operate a greywater recapture system. We follow reasonable practices to limit wash-water runoff and comply with local bylaws. We make no claim of water reclamation.

19. Your account and eligibility

You are responsible for your account and for the accuracy of the information you give us, including your address, tap access, and access instructions. Keep your password secure.

To use the Service and enter this agreement, you must be at least 19 years old and able to enter a binding contract.

20. Intellectual property

The Stinky Bins name, brand, site, and content are ours. You may not copy or use them without permission.

21. Changes to these Terms and price changes

We may update these Terms. We will post the new version with a new effective date. For material changes, including changes to price, billing cadence, the dirty-bin surcharge, the reschedule fee, or cancellation terms, we give you advance notice and the right to cancel before the change takes effect. We do not amend this contract by treating your silence or your continued use as consent.

22. Dispute resolution and governing law

These Terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Before filing a claim, contact us so we can try to resolve it directly. If we cannot resolve it, you agree to the courts of British Columbia, subject to any non-waivable consumer right to another forum. We do not require arbitration and we do not ask you to waive class actions.

23. Severability

If any part of these Terms is found unenforceable, that part is limited or removed to the least extent needed, and the rest of these Terms stays in effect.

24. Entire agreement

These Terms, together with the Privacy Policy and the Refund and Cancellation Policy, are the entire agreement between you and us about the Service, and replace any earlier understandings about it.

25. Assignment

We may assign these Terms, for example on a sale of the business. You may not assign these Terms without our consent.

26. No waiver

If we do not enforce a right or term, that is not a waiver of it. A waiver is effective only if we give it in writing.

27. Force majeure

We are not liable for failure or delay caused by events beyond our reasonable control, such as fire, flood, severe storms, labour disruption, supply failure, utility failure, or government action. This clause is separate from the weather and rescheduling clause in section 17. Where a force majeure event affects a clean, we reschedule and do not charge for the affected clean.

28. Electronic acceptance

You accept these Terms by checking an unchecked "I agree to the Terms, Privacy Policy, and Refund Policy" box at booking or account creation. We record the timestamp, the version you accepted, and your IP address.

29. Notice

We give you notice by email to the address on your account. You give us notice by email to hello@stinkybins.ca. Each party is responsible for keeping its email address current.
